1. Agreement to these Terms

These Terms & Conditions govern access to and use of the Legacy NFTY website, member dashboard, account tools, wallet records, transaction workflows, administrator-managed plans, referral features, communications and related services (collectively, the “Platform”).

By creating an account, accessing the Platform or using any feature, you confirm that you have read, understood and agreed to these Terms, the Privacy Policy, AML Policy and Risk Disclosure. If you do not agree, do not create or use an account.

2. Important nature of the Platform

Legacy NFTY provides digital account administration, transaction-recording tools and access to features configured by the Platform administration. Digital asset and plan-related activity can involve substantial risk. Registration, account approval or display of a plan does not guarantee acceptance, profit, capital preservation, liquidity or any particular result.

Unless expressly stated in a separate written agreement, Legacy NFTY does not provide personalised financial, investment, legal or tax advice. Information displayed on the Platform is general and should not be treated as a recommendation suited to your individual circumstances.

3. Eligibility

You may use the Platform only if you are legally capable of entering a binding agreement and are permitted to use the relevant services under laws applicable to you. You must not use the Platform from a prohibited location or where use would violate law, regulation, sanctions or contractual restriction.

Legacy NFTY may require age, location, identity, source-of-funds, source-of-wealth or other eligibility information. Access to one feature does not create an entitlement to access every feature.

4. Account registration

You must provide accurate, complete and current information. You may not register using a false identity, another person's details, temporary information intended to avoid verification or multiple accounts designed to bypass limits or controls.

You are responsible for keeping profile details current. Legacy NFTY may request supporting evidence and may restrict features until information has been verified.

5. Account security

You are responsible for protecting your password, registered email, authenticator device, authenticator credentials and account sessions. You must notify Legacy NFTY promptly if you suspect unauthorised access, credential disclosure or account compromise.

You must not share account access or allow another person to operate the account on your behalf unless the Platform has expressly approved an authorised arrangement. Activity completed through valid credentials may be treated as authorised until the Platform receives and acts on a credible compromise report.

6. Identity verification and compliance review

Legacy NFTY may require identity documents, address information, transaction evidence, source-of-funds information, source-of-wealth information or enhanced due diligence. Documents must be authentic, current and belong to the person or entity operating the account.

Verification may be repeated when information changes, activity appears unusual, legal requirements evolve or account risk increases. Failure to provide satisfactory information may result in delay, restriction, rejection or account closure.

7. Wallet balances and ledger records

Balances displayed on the Platform are supported by internal ledger records showing credits, debits, locks, releases, fees, adjustments and reversals. Unless expressly stated otherwise, a displayed balance is an account record and is not a bank deposit, government-insured balance or guarantee of immediate redemption.

You must review account records and report a suspected error promptly. Legacy NFTY may correct duplicate, mistaken, unauthorised or technically incorrect ledger entries and will record the corresponding adjustment.

8. Deposits

Deposits must follow the asset, network, address and evidence requirements displayed by the Platform. You are responsible for confirming every transaction detail before sending. Transfers sent using an unsupported asset, wrong network, incorrect address or missing memo may be delayed or permanently lost.

A blockchain confirmation or submitted transaction ID does not itself guarantee account credit. Deposits may be reviewed for network confirmation, duplication, ownership, compliance, amount and other requirements before approval.

9. Withdrawals

Withdrawal availability may depend on available balance, locked amounts, verification status, security controls, network conditions, limits, fees, compliance review and Platform rules. A submitted withdrawal is a request and is not complete until processed and reflected as final.

You are responsible for the destination address and network. Blockchain transfers may be irreversible. Legacy NFTY may delay, reject or cancel a request when information is incomplete, account security is uncertain, activity is prohibited or review is required.

10. Plans and participation

Plan information may include amount ranges, duration text, administrative terms and risk statements. Plans may be changed, paused, limited or withdrawn. Participation may require verification and explicit approval.

No plan, displayed figure, historical result, example or communication guarantees profit or return of capital. Market, technology, liquidity, operational, counterparty, regulatory and other risks may affect outcomes.

11. Referrals

Referral rewards are governed by the rules active when the qualifying event becomes final. Registration or pending activity does not necessarily qualify. Self-referrals, circular referrals, duplicate accounts, misleading promotion, spam and manipulation are prohibited.

Rewards may be withheld, cancelled or reversed when the underlying event is reversed, ineligible, duplicated, disputed or associated with prohibited activity.

12. Fees, taxes and network costs

Fees or limits may apply to Platform features and blockchain networks. Relevant information will be displayed where reasonably practicable. Network costs can change and may be outside Legacy NFTY's control.

You are responsible for taxes, declarations, filings and professional advice applicable to your activity. Legacy NFTY does not provide individual tax advice.

13. Prohibited use

You must not use the Platform to:

• violate law, sanctions, court orders or third-party rights;
• launder money, finance prohibited activity or conceal beneficial ownership;
• commit fraud, impersonation, account takeover or identity misuse;
• manipulate referrals, rewards, plans, transaction evidence or system records;
• introduce malware, probe security, bypass controls or disrupt service;
• use automated tools without written permission;
• harass users or staff, send spam or publish deceptive claims;
• sell, rent or transfer an account without approval.

14. Third-party networks and services

The Platform may depend on blockchain networks, email providers, hosting, telecommunications, security services or other third parties. Legacy NFTY does not control their availability, confirmation times, fees, rules or failures.

Links to third-party websites are provided for convenience and do not imply endorsement. You are responsible for reviewing third-party terms and risks.

15. Communications and notices

You agree that Legacy NFTY may send account, security, compliance, transaction, policy and service communications through email, dashboard notices or other official contact details you provide. You must keep those details current.

Marketing communication preferences do not prevent delivery of essential account or legal notices.

16. Suspension, restriction and closure

Legacy NFTY may restrict, suspend or close an account or feature when reasonably necessary for security, compliance, legal, operational or risk-management purposes, including suspected fraud, inaccurate information, prohibited activity, account compromise, legal requests or repeated violation of these Terms.

Where appropriate and legally permitted, the Platform may request additional information or provide instructions regarding remaining account records or pending requests.

17. Service availability and changes

The Platform may be updated, maintained, interrupted or unavailable. Features, limits, interfaces, rules and plans may change. Legacy NFTY does not guarantee continuous, error-free or uninterrupted access.

Members should not submit duplicate financial requests during an outage or unexpected error without first checking account history.

18. Intellectual property

The Legacy NFTY name, logos, interface, text, graphics, software and original Platform materials are owned by or licensed to Legacy NFTY and are protected by applicable rights. You receive a limited, revocable, non-transferable right to use the Platform for its intended purpose.

19. Disclaimers and limitation of liability

To the maximum extent permitted by applicable law, the Platform is provided on an “as available” basis without guarantees regarding uninterrupted availability, future performance, digital asset value or suitability for a particular purpose.

Legacy NFTY will not be responsible for losses caused by market movement, user error, unsupported transfers, disclosed credentials, compromised email or devices, third-party failures, blockchain conditions, legal changes or events outside reasonable control, except where liability cannot lawfully be excluded.

20. Indemnity

To the extent permitted by law, you agree to be responsible for claims, costs or losses arising from your unlawful use, material breach of these Terms, infringement of rights or submission of false information.

21. Changes to these Terms

These Terms may be updated to reflect changes in features, risk, operations or legal requirements. The updated version will be published with a revised date. Continued use after the effective date constitutes acceptance where permitted by law.

22. Governing requirements and enforceability

Applicable law, jurisdiction and dispute requirements may depend on the legal entity operating the Platform, the user's location and any separate written agreement. If a provision is unenforceable, the remaining provisions will continue to the extent permitted.
